The 2019 Supreme Court error of 2019 and the devastating revelations about the Trump administration’s fraud
A major mistake in the intervention of the Federal government against the Salvadoran Adrego Garcia has thrown the Trump administration into disrepute and may soon lead to his release.
During a federal hearing last week, US District Judge Paula Xinis heard arguments after she blocked Arego Garcia’s deportation pending a habeas appeal. The government asked him to subpoena the order as a key witness and ice chief John Cantu testified that he sponsored the Department of Homeland Security to send Arego Garcia to Liboa.
But it’s a surprising discovery that could lead to Abrego Garcia’s release.
In 2019, Immigration Judge David Jone denied Garlia’s request for Asylum but granted him protection from deportation to El Salvador due to threats from his extremist group. His decision, which was critical in the current federal case, never officially ordered Garcia to leave the United States.

“There is no order to be removed from the dock, from the record,” U.S. District Judge Paula Xinis said Thursday at the close of a four-hour hearing. “You can’t fake it ’til you make it. You have to have it. … you have to have order. It has to be an order that is remembered somewhere and I don’t have it.”
Without that order, the legal basis for the Trump Administrations case could collapse entirely, but the error is only one part of a broader and more troubling pattern in this case.
In court, the government’s lawyers repeatedly insisted that the construction that Garcia had chosen in Costa Rica, where he owned family property, was “not an option” and he was no longer willing to accept him. However, those comments were directly contradicted this week by Costa Rica’s Minister of Security, Mario Zamora Corroro, who told ABC news:
“COSTA RICA’s Offer to Find Mr. Alego Garcia for humanitarian reasons,” RASA’s security minister, Mario Zamora, told ABC news in a statement. “My letter dated August 25, 2025, is the official position of the government.”
This revelation revealed the disturbing truth about the dismissal of the administration to discuss Garcia in Liberia, which does not focus on seeking needs but instead seems to have had difficulty in retaliating and protecting his legal rights.
Arego Garcia’s lawyers argued against the government’s cycling in four areas “which include Uganda, Esatini, Ghana, and now, the opportunity to identify that process that needs it.”
Arego Garcia’s lawyer, Simon Sandoval – Moshenberg, issued a statement saying, “The government has lost all credibility to do anything other than punish this country in Africa, or any African country.”
The government’s credibility took a further hit when Cantú was unable to answer basic questions about the administration’s communications with Costa Rica or the assurances received in Liberia.
Cantu admitted that his knowledge about this case came entirely from a five-minute videocon where the Ministry of State read him a prepared statement, leading to the creation of Judge Xinis to ignore the testimony of canturan for and knowledge not only of the process of Garcia but also.
“This is the point that this witness knows zero information about the content of the announcement,” said Judge Xinis.
Drew Ensign, the government’s attorney, argued that Alego Garcia’s removal order from El Salvador would only exist if there was an extradition order issued.
“There is a very strong argument from Mr. Alego that the removal of the third country is obtained by a valid order, and since his colleague admitted that there is no order for the removal of the record,” answered Judge Xinis.
The hearing underscored the Trump Administration’s mishandling of Garcia in March, after officials illegally removed him from El Salvador, known as ceCot cectot, despite returning him to the US after Judge Xinis intervened.
Garcia’s lawyers are now arguing that the criminal case is against him, and the next pressure to force him to the African nations, is revenge for handling the shame of the court.
“It leaves a bitter taste in the mouth of revenge, right? I can’t think of any reason why we fight for this case and why the lawyer of Simon García, said.
Judge Xinis has not yet, but his execution in August prevents the removal of ábrego García from the US is in place.
If the judge upholds his acquittal, it will mark a decisive rebuke of that approach and end a campaign of overreaching government retaliation that goes beyond legal and ethical accountability.
Judge Xinis said he would rule that he could be released as soon as possible before adding that “these are serious issues.”
