Georgia judge strikes down city’s Gun Ordinance as unconstitutional, inexplicable

A Georgia judge on Wednesday threw out a case against a man who was accused of violating the city of Savannah’s law prohibiting guns in open cars, a decision that the US constitution.
Clayton PAPP was cited by Savannah Police for violating the law, which provides fines and possible jail time for leaving firearms in unlocked vehicles, in August 2024. His attorney asked a suspended judge to dismiss the case.
The decision by Chatham County Judge Recorder Brian Joseph Huffman Jr. He probably only applies to the PApp case, as he is challenging the Ordinance as part of his criminal defense.
Savannah’s mayor said the city will continue to enforce the law.

“We’ve had this going on for some time now, and we’ve reduced the number of guns stolen from unlocked vehicles in Savannah,” Memor Ma Johnson told reporters.
Johnson pushed the gun policy as a way to promote reliable gun ownership without infringing on their rights to own or own their own guns. He said Wednesday that the number of guns stolen from unlocked vehicles reported to Savannah Police has increased from more than 200 in 2023 to only 100 this year.
Savannah’s city council voted last year to ban guns from unlocked vehicles, with violators facing fines of up to $1,000 in jail.
Supporters of the measure say the Act will make it more difficult for criminals to steal guns in the Peach State, where Republican state lawmakers have made it easier to own and carry guns.
“Concerns about firearms being stolen from vehicles and later used in violent crimes are warranted,” the judge said in his ruling. “However, good intentions do not bend the rule of law from the constitution.”

Huffman Jr. filed a lawsuit Wednesday that declared Savannah’s law “also not good.”
The judge said the law violates a federal law that prohibits local governments from regulating the “acquisition, ownership, transportation, or (or) carrying” of firearms.
He also issued a ruling that the Ordinance “Mesdens Conduct covered by the plain text of the Second Amendment.”
General Carr Carr Carr Carr Cark of Georgia hailed the decision as “a great victory for gun owners who keep guns, who should not be punished for the actions of criminals and thieves.”
While the judge found that Savannah’s regulation is illegal, the decision probably only applies to the PApp case because it is not a broad dispute, Gerony Kreis’s lawyer, told the organized press.
“In theory, the city could continue to use the Ordinance and leave it to individual defendants to raise this question again as a defense,” Kreis said.

A separate lawsuit brought by another gun owner seeking to stop enforcement of the Ordinance was dismissed last year in Chatham County Superior Court, because he was not a former resident.
