In matters that can be filed under ‘disappointment, but not surprising,’ the Supreme Court issued a 6th ruling that allows Texas to use its newly redrawn map for the 2026 midterms.
According to CBS News, the decision came after a panel of Federal judges struck down the map last month. In the first decision, the judges found the map inconsistent with the fraud, believing it to be a gerrymander. In an unsigned order, the Supreme Court said it had “repeatedly emphasized that lower state courts should not change election laws on Election Day,” and the district court “violated that rule here.”
“The District Court improperly interfered with the active campaign, causing much confusion and upsetting the state’s delicate balance in the election,” the order continued.

So the logic of the Supreme Court boils down to “It doesn’t matter if it’s wrong, you just did it, so just accept it.”
Supreme Court Justice Elena Kagan was sent back to form this scripted event. “The court issued a 160-page opinion detailing its findings. But this court is revoking that premise based on its discovery, over the holiday weekend, of the cold-document record.” Kagan wrote. “We are a higher court than the District Court, but we are not better when it comes to making a decision based on the truth,” he added.
“We won! Texas is honest and legal – more red,” said Texas Gov. Greg Abbott in a statement celebrating the decision. “The new concessional districts better align our representation in Washington DC with the values of our state,” Abbott added. “This is a victory for the voters of Texas, in common sense, and for the US Constitution.”

Texas Democrats were lauding the decision, and with good reason. Over the summer, Texas Democrats used every measure at their disposal to block Texas’ redistricting effort. They hid, ran away from the state to break the quroum, and their efforts even resulted in the state’s view. Nicole Cortier who is treated as a political prisoner on the floor of the house.
“The Supreme Court has failed the voters of Texas Today, and they have failed the American democracy. This is what the end of the VOTING RETORT AST looks like:” The courts will not protect the face, “says the testimony of the Democratic Capend.
The Texas map sparked a nationwide renaissance battle. In July, Abbott called a special session focused on recovery at the request of President Donald Trump. The GOP controls the house by a narrow margin, with Democrats only needing an overall gain of three seats to take control next year. The Texas state legislature finally passed a map that added five new Republican-leaning districts.
While the Supreme Court allowed Texas to use its draft map, the gains made within it have been hijacked by California’s redistricting efforts. California Gov. Gov. Newlom was the first Democratic leader to throw out a partner when he announced “action to answer the election” in August. That stand prompted a special election last month focused solely on Prop 50, which transfers control of state maps from an independent redistricting committee to the Legislature. California voters overwhelmingly approve of the measure, and the news intends to use a map that shows exactly the gains made in Texas.
Virginia’s Democrat Sheduly Hellofly also announced a revival effort last month that aims to create two to three seats in the House, with Chicago and Maryland also looking at their maps.
So while a Supreme Court ruling may not sway Democratic voters in Texas, the election numbers for House control are pretty close.
